This article employs the qualitative legal historical methodology to investigate the historical dynamics underpinning Hungary’s shifting refugee policies. The analysis uncovers a significant shift in Hungary’s approach to refugees. Following World War I, the Trianon agreement, which led to territorial loss and population displacement, posed migration challenges that Hungary addressed on a case-by-case basis. Furthermore, after 1989, Hungary aligned its legal systems with international standards. It ratified the 1951 Refugee Convention, marking the first official regulation of refugees under Decree 101. In 2007, upon EU accession, Hungary enacted the Asylum Act 2007, aligning it with the Dublin regulation and relevant EU directives, which formed the foundation for refugee crisis legislation in 2015. The study also examines the 2011 constitutional amendment, indirectly creating sociocultural barriers between Hungarian society and refugees.}, year = {2024}, eissn = {1804-8285}, pages = {47-72}, orcid-numbers = {Bahri, Mohammad Thoriq/0000-0003-0913-5342} } @inproceedings{MTMT:34754084, title = {The Analysis of the Immigration Politicization Issue in France Based on the Issue Evolution Theory}, url = {https://m2.mtmt.hu/api/publication/34754084}, author = {Rahoui, Sarra}, booktitle = {Proceedings of the 4th Borobudur International Symposium on Humanities and Social Science 2022 (BIS-HSS 2022)}, doi = {10.2991/978-2-38476-118-0_40}, unique-id = {34754084}, year = {2024}, pages = {351-361} } @article{MTMT:34753837, title = {Enthusiastic claimants, reluctant courts: The empirical and critical analysis of punitive damages in Chinese intellectual property law}, url = {https://m2.mtmt.hu/api/publication/34753837}, author = {Xiao, Baiyang}, doi = {10.1111/jwip.12297}, journal-iso = {J WORLD INTELLECT PROPERTY}, journal = {JOURNAL OF WORLD INTELLECTUAL PROPERTY}, unique-id = {34753837}, issn = {1422-2213}, abstract = {The availability of punitive awards varies across different common law jurisdictions. In recent years, China, as a civil law jurisdiction, has progressively introduced a comprehensive punitive damages system in Intellectual Property (IP) law in recent years. To investigate how this common law product functions in the civil law system, this paper scrutinizes the evolution and functions of punitive damages and depicts the map of punitive damages in Chinese IP law. Then this paper reports and analyses 657 IP judgments involving the application of punitive damages that were tried and decided in all parts of mainland China by all levels of courts from June 1, 2021, to May 31, 2022. Our empirical data shows that punitive damages are frequently sought by claimants, yet courts are reluctant to award them due to the complexities in determining the basis for calculation and judges' reluctance towards detailed legal reasoning. Furthermore, a critical analysis of the application of punitive damages in IP trials is provided, critiquing the court's preference for statutory damages, the complexity in determining the basis and multipliers for calculation, and the strict standard of proof, which accounted for the small portion of punitive damages awarded in judicial practices.}, year = {2024}, eissn = {1747-1796}, pages = {1-24} } @inbook{MTMT:34727041, title = {Cabo Delgado, the northern coastal part of Mozambique. turbulent past, chaotic present… and prosperous future?}, url = {https://m2.mtmt.hu/api/publication/34727041}, author = {Pintér, Tibor}, booktitle = {Green and Digital Transitions: Global Insights into Sustainable Solutions}, doi = {10.14232/gtk.gdtgiss.2024.4}, unique-id = {34727041}, abstract = {The importance of Mozambique's northern coastal province of Cabo Delgado has increased with the outbreak of the Russian-Ukrainian war, although it was no less important before. In the last ten years, large reserves of natural gas and gemstones have been discovered and the last few years have seen the rise of a jihadist movement under the aegis of the Islamic State. Russian aggression has increased Europe's appetite for natural gas in its desire to reduce Russian energy dependence. The discovery of natural gas in Mozambique has created huge opportunities for the poor country, as international gas companies have invested heavily in Cabo Delgado. In today's world, accusations of human rights violations have become one of the primary challenges among nations in terms of upholding sovereignty. In accordance with the United Nations Charter, the Security Council may be called upon by the parties to a dispute, the General Assembly, or the Secretary-General, or it can act ex officio to seek a peaceful resolution or adjust a situation through peaceful means. If the Security Council determines that the situation or dispute in question may constitute a threat to international peace and security, it may invoke its powers under Chapter VI of the United Nations Charter. The purpose of this study is to examine the extent of the Security Council's competence and the powers it possesses when carrying out its conciliatory role in cases involving human rights violations by a Member State and conflicts that may arise regarding the interpretation and application of the United Nations Charter.}, year = {2023}, eissn = {2560-1067}, pages = {135-162} } @article{MTMT:34754099, title = {The Issues of Young Lawyers in the Legal Profession System in Tunisia}, url = {https://m2.mtmt.hu/api/publication/34754099}, author = {Rahoui, Sarra}, journal-iso = {COMP LAW WORK PAP}, journal = {COMPARATIVE LAW WORKING PAPERS}, volume = {7}, unique-id = {34754099}, year = {2023}, eissn = {2560-1911} } @article{MTMT:34754072, title = {The Politicization of Immigration within the EU's External Policies}, url = {https://m2.mtmt.hu/api/publication/34754072}, author = {Rahoui, Sarra}, doi = {10.46942/SIDM.2023.2.237-250}, journal-iso = {STUD IURISPRUD DOCTORAND MISKOLC}, journal = {STUDIA IURISPRUDENTIAE DOCTORANDORUM MISKOLCIENSIUM-MISKOLCI DOKTORANDUSZOK JOGTUDOMÁNYI TANULMÁNYAI}, volume = {26}, unique-id = {34754072}, issn = {1588-7901}, year = {2023}, pages = {237-250} } @inbook{MTMT:34743372, title = {A Lett Ortodox Egyház hivatalos szövegeinek tartalomelemzése.
