A tanulmány hazai és nemzetközi szakirodalom feldolgozására, valamint konkrét jogesetek elemzésére épül.Megállapítások: A vizsgálat rámutat arra, hogy a confirmation bias a büntetőeljárás valamennyi szakaszában jelen lehet, és gyakran önmegerősítő mechanizmusokon keresztül torzítja a bizonyítékok értékelését. A torzítás hozzájárulhat az alternatív verziók figyelmen kívül hagyásához, a „tunnel vision” kialakulásához, valamint rendszerszinten is felerősödhet. Megállapítható továbbá, hogy a szakértői bizonyítás és a technológiai eszközök alkalmazása sem zárja ki a torzítás megjelenését.Érték: A tanulmány hozzájárul a büntetőeljárás tisztességével kapcsolatos tudományos diskurzushoz azáltal, hogy a kognitív torzítások szerepét rendszerszinten elemzi. Eredményei elősegíthetik olyan eljárási garanciák és módszertani megoldások kialakítását, amelyek képesek mérsékelni a döntéshozatal torzulásait.
