A közvagyon átalakításának, a "politikai tulajdon" létrehozásának és működtetésének jogügyletei jellemzően jogsértők, ellentétesek a jóhiszeműségre és tisztességre, valamint a jóerkölcsre vonatkozó magánjogi követelményekkel. A rendszerszintű vagyoni visszaélések korrekciójának igazságossági és alkotmányjogi feltételei közé tartozik a jogállam és a tulajdon elveinek tiszteletben tartása.
