Ennek során különös figyelmet szentel annak, hogy az állam képes-e és akarja-e érvényesíteni az uniós előírások betartását az állami tőkét befektető alapkezelők és a portfóliócégek kiválasztásánál. Az uniós alapokból érkező források jelentősen növelték az állami kockázati tőke mennyiségét, ugyanakkor korlátozták annak térbeli és időbeli felhasználhatóságát. Ez nehezen volt összeegyeztethető a kockázatitőke-befektetések természetével és időigényével. A kockázati tőkét a finanszírozást kereső vállalkozásokhoz közvetítő alapkezelők mozgásterét az állami támogatások tiltását biztosító kiterjedt szabályrendszer is jelentősen szűkítette. A visszaélések felderítését azonban akadályozta, hogy a befektetők kiválasztásához kiírt pályázatok mindvégig, a nyertes alapok befektetései pedig a programok lezárultáig nem voltak megismerhetők.
